Effective Date: October 1, 2026
These Terms and Conditions (“Terms”) govern your access to and use of this website and any pages, forms, features, or online services made available through it (collectively, the “Site”). The Site is operated by Milliken & Matthews, PLLC (“Milliken & Matthews,” “the firm,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms and any additional terms or policies posted on the Site. If you do not agree, do not use the Site.
Portions of this Site may be considered attorney advertising under applicable rules. The Site is provided for general informational purposes and is not a solicitation to represent you in any particular matter.
Using the Site, submitting a form, or sending an email or other communication to the firm does not create an attorney-client relationship. An attorney-client relationship is established only after Milliken & Matthews, PLLC agrees to the representation and a written engagement agreement has been completed.
Do not send confidential or time-sensitive information through the Site or by email before an engagement has been confirmed. Information sent before that point may not be treated as confidential or privileged, and may not prevent the firm from representing another party in the same or a related matter.
Content on the Site is general information and is not legal, tax, accounting, investment, or other professional advice. It does not account for your circumstances and may not reflect the most current developments in the law.
Legal matters can involve significant consequences and short deadlines. You should consult an attorney about your specific situation rather than relying on anything published here. Nothing on the Site is a substitute for advice from a lawyer who has reviewed the facts of your matter.
Prior results do not guarantee or predict a similar outcome in any future matter. Every matter depends on its own facts, the applicable law, and circumstances outside the firm's control. Any description of the firm's experience, practice areas, or prior matters is not a promise or warranty about the outcome of your matter.
Unless otherwise stated, the firm's attorneys are licensed to practice in the State of Tennessee. Nothing on the Site is an offer to practice law in a jurisdiction where the firm's attorneys are not licensed, and information on the Site describes Tennessee law unless stated otherwise.
Any fee information, estimate, or range described on the Site is general and is not a quote or an agreement to perform services at that amount. Fees, scope, and terms for a specific matter are set out in a written engagement agreement.
Electronic communications, including email, text messages, online forms, and file transfers, may not be secure and may be targeted by fraud.
NEVER SEND FUNDS OR RELY ON NEW OR CHANGED WIRE OR PAYMENT INSTRUCTIONS BASED SOLELY ON AN EMAIL, TEXT MESSAGE, OR OTHER ELECTRONIC MESSAGE. BEFORE SENDING FUNDS, INDEPENDENTLY VERIFY THE INSTRUCTIONS BY CALLING A TRUSTED PHONE NUMBER YOU HAVE PREVIOUSLY CONFIRMED FOR MILLIKEN & MATTHEWS, PLLC. DO NOT USE A PHONE NUMBER CONTAINED ONLY IN A SUSPICIOUS OR UNEXPECTED MESSAGE.
If you receive a request to change payment instructions, account information, or other sensitive details, contact the firm through independently verified contact information before taking action. We are not responsible for losses caused by a user's failure to follow reasonable verification procedures, to the fullest extent permitted by law.
You agree that information you submit through the Site will be accurate, current, and complete to the best of your knowledge. You may not submit information that is fraudulent, unlawful, misleading, defamatory, infringing, malicious, or designed to interfere with the Site.
Do not submit passwords, full payment card information, wire instructions, bank account credentials, Social Security numbers, or other highly sensitive information through a general website form. You represent that you have the right and authority to provide any information or documents you submit to us.
Your use of the Site is also subject to the Privacy Policy posted on the Site, which is incorporated into these Terms by reference.
By providing contact information through the Site, you authorize us to use that information to respond to your request and to send communications related to it as permitted by law.
Milliken & Matthews, PLLC and Luminary Title Group, LLC are separate legal entities under common ownership. Luminary Title Group does not provide legal advice or legal services. Any legal services are provided solely by Milliken & Matthews, PLLC and require a separate engagement agreement directly with the law firm. Engaging Luminary Title Group does not create an attorney-client relationship with Milliken & Matthews, PLLC. Clients of Luminary Title Group are not required to use Milliken & Matthews, PLLC and may select legal counsel of their choosing.
The Site and its content, including text, graphics, logos, trademarks, service marks, photographs, videos, designs, page layouts, software, and other materials, are owned by or licensed to Milliken & Matthews, PLLC and are protected by applicable intellectual property laws.
Subject to these Terms, you may access and use the Site for your personal or legitimate business purposes related to evaluating or obtaining our services. You may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, publicly display, scrape, harvest, frame, or exploit Site content without prior written permission, except as permitted by law.
You may not use the Site to violate any law or regulation, infringe the rights of another person, impersonate another person or entity, transmit malware or harmful code, attempt to gain unauthorized access to systems or data, interfere with Site operation, conduct automated scraping or data harvesting without permission, or use the Site for any unlawful or deceptive purpose.
The Site may contain links to or integrations with third-party websites, portals, software, payment processors, scheduling tools, document platforms, government resources, or other services. We do not control third-party services and are not responsible for their content, availability, security, privacy practices, or terms. Your use of a third-party service is governed by that third party's terms and policies.
We may modify, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You are responsible for maintaining appropriate security on your devices, accounts, passwords, and communications.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT MADE AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." MILLIKEN & MATTHEWS, PLLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND AVAILABILITY.
This disclaimer applies to the website and general website content only. It does not alter the firm's obligations to a client under a written engagement agreement or under the Tennessee Rules of Professional Conduct.
TO THE FULLEST EXTENT PERMITTED BY LAW, MILLIKEN & MATTHEWS, PLLC AND ITS OWNERS, ATTORNEYS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING SOLELY FROM USE OF THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT, IF ANY, YOU PAID US SPECIFICALLY FOR ACCESS TO THE SITE DURING THE TWELVE MONTHS BEFORE THE CLAIM OR $100.
This section applies to use of the Site only. It does not limit the firm's professional responsibility to a client under an engagement agreement or under applicable rules, and it does not apply where prohibited by law.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Milliken & Matthews, PLLC and its owners, attorneys, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Site, your violation of these Terms, your infringement of another person's rights, or information or materials you submit through the Site.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any legal action arising solely from these Terms or use of the Site will be brought in the state or federal courts located in Sumner County, Tennessee, unless applicable law requires otherwise.
Nothing in this section changes any governing-law, forum, dispute-resolution, or venue provision contained in a separate engagement agreement.
We may update these Terms from time to time. The revised version will be posted on the Site with an updated effective date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law. Material changes will apply prospectively unless otherwise required or permitted by law.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of that provision or any other right.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or other business transfer, subject to applicable law.
These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and Milliken & Matthews, PLLC concerning general use of the Site. They do not replace or modify any engagement agreement governing legal services.
